    Terms of Service

    Please read these terms carefully before using our services. Section 18 contains an arbitration agreement and class action waiver that affects your legal rights.

    These Terms include a binding arbitration agreement and a class action waiver (Section 18), a limitation of liability with a monetary cap (Section 16), an "as-is" disclaimer of warranties (Section 16), an authorization for scheduled future card charges if you select deferred removal (Sections 6 & 12), a verbal-authorization process for phone orders (Section 7), and a 48-hour notice requirement for any claim of property damage caused by our crew or vehicles (Section 16). By placing an order or using our services, you agree to all of these terms.

    1. Definitions & Agreement to Terms

    These Terms of Service ("Terms") are a binding agreement between you ("you," "Customer") and Detroit Pumpkin Company LLC, doing business as Detroit Pumpkin Company ("we," "our," "us," or "Company"). "Services" means our website, products, seasonal porch displays, removal services, business coaching, gift cards, referral programs, and any related communications or content. By accessing our website, placing an order, providing a verbal phone-order authorization, or otherwise using our Services, you agree to be bound by these Terms, our Refund Policy, and our Privacy Policy. If you do not agree, do not use our Services.

    If you place an order on behalf of another person or property (for example, a gift, a household member, or a property you do not own), you represent that you have authority to bind that person or property to these Terms.

    2. Eligibility

    Our Services are intended for individuals 18 years of age or older. By using our Services, you represent that you are of legal age to enter into a binding contract in your jurisdiction and that the information you provide is accurate and complete. Our Services are not directed to children, and we do not knowingly collect personal information from anyone under 13.

    3. Service Description

    Detroit Pumpkin Company provides seasonal fall decorating services including:

    • •Delivery and professional setup of pumpkin displays for residential properties
    • •The Heritage — custom, multi-level estate installations with dedicated designer consultation, on-site palette customization, and white-glove design and layout
    • •Custom installations for businesses, events, and special occasions
    • •Optional removal and disposal services, including our end-of-season Porch to Pasture program (pumpkins are donated to participating Michigan farms to feed animals where available)
    • •Business coaching and consultation services
    • •Grand Gift Cards — prepaid gift cards (priced from $50 to $150 depending on the display) redeemable toward a porch display by a designated recipient, where Detroit Pumpkin Co. matches the buyer's contribution dollar for dollar
    • •Gift a Full Display — a buyer purchases an entire porch display on behalf of a recipient at the recipient's address, with the November removal fee waived as a gifting perk and the buyer earning Porch Points back as a thank-you
    • •The Big Mini Promise — an optional charitable giving program that adds mini pumpkins to displays when customers donate to a local Detroit charity at checkout
    • •Referral & Porch Points programs for existing customers

    4. Seasonal & Natural Product Disclaimer

    Natural Product Variations: Pumpkins and seasonal decorations are natural, agricultural products. Size, color, shape, texture, and appearance may vary from photos and descriptions. We source the highest quality products from Michigan farms, but cannot guarantee exact specifications.

    Perishable Nature: All pumpkins and seasonal items are perishable and will naturally decay over time. Environmental factors including temperature, moisture, sunlight, and wildlife will affect longevity. Subject to the express 30-Day Freshness Promise in our Refund Policy (which covers premature rot within the first 30 days of delivery), we are not responsible for natural decay, discoloration, or deterioration after delivery.

    Weather Impact: Michigan autumn weather can be unpredictable. Freezing temperatures, excessive rain, wind, or early snow may affect product appearance and longevity. We cannot control or be held liable for weather-related impacts.

    Wildlife & Environmental Factors: Pumpkins may attract wildlife including squirrels, deer, raccoons, and birds. We are not responsible for wildlife damage, consumption, or displacement of decorations.

    5. Delivery & Installation

    Delivery Windows: Deliveries run from September 11through October 17, 2026. You will receive your estimated delivery week in early September, followed by confirmation of your specific delivery day. Specific delivery dates and times are subject to route logistics, weather, and product availability.

    Service Area & Free Delivery: Detroit Pumpkin Company provides free delivery throughout our listed Metro Detroit service area. Your ZIP code must be within the service area shown on our service area page, which may be updated from time to time. If your address is outside that area, please contact us before ordering and we will let you know whether we can accommodate it.

    Property Access: You are responsible for ensuring clear, safe access to your delivery location. This includes unlocked gates, cleared walkways, absence of aggressive pets, and safe parking for our delivery vehicle. If we cannot safely access your property, delivery may be rescheduled, and additional fees may apply.

    Access Codes & Alarm Codes: If you choose to share gate codes, garage codes, lockbox codes, or alarm codes with us to facilitate access while you are not home, you do so voluntarily and at your own risk. We treat such information confidentially and use it solely to complete your delivery or removal. We are not liable for the consequences of inaccurate codes, codes that fail to disarm an alarm, false-alarm fees charged by third parties (including monitoring companies or municipalities), or any damage or loss arising from accessing your property using codes you provided.

    Elevated & Multi-Level Installations (Heritage and Custom): Heritage and other custom installations may require our crew to use step stools, short ladders, or to work on porches, steps, columns, and other elevated or multi-level surfaces of your home. By scheduling such an installation, you represent that the relevant surfaces are structurally sound, that there are no hidden hazards (loose railings, rotted decking, unsecured columns, exposed wiring, etc.), and you authorize our crew to perform reasonable installation work on those surfaces. We use professional judgment to decline any placement we determine to be unsafe; in that case we will work with you to find a safe alternative.

    Surface Preparation: Customer is responsible for ensuring delivery surfaces (porches, steps, entryways) are structurally sound and capable of supporting the weight of pumpkins and decorations. We recommend placing protective barriers under pumpkins on wood or painted surfaces to prevent potential staining.

    Installation Discretion: Our team will use professional judgment to arrange your display. While we strive to match customer preferences, final placement decisions may vary based on space, safety, and aesthetic considerations.

    Delivery Week Selection: After your order is placed, you will receive access to your Porch Portal where you may select a currently available delivery week at no additional charge. Once a week's available booking capacity is filled or the selection window closes, that week can no longer be selected through the portal. Selecting a delivery week does not guarantee a specific delivery day or time within that week; specific day assignments are communicated closer to your delivery.

    6. Removal & Disposal Service

    Optional Service: Removal and disposal of your porch display is an optional add-on. Removal is scheduled on a seasonal basis and dates are subject to weather conditions and route logistics. We make reasonable efforts to accommodate preferred weekends but cannot guarantee specific pickup times or windows.

    Removal Paid at Checkout: When you add removal service at checkout and pay for it at that time, the fee is charged as part of your total order. Customers who pay for removal at checkout receive a discount off the standard removal rate ($15 for Sprout and Vine displays, $25 for Patch and Grand Harvest displays).

    Removal Billed Before Pickup — Authorization for Scheduled Future Charge: If you select the "Pay later" removal option during checkout, you authorize Detroit Pumpkin Company to securely store your payment method via Stripe and to charge that payment method on a single, scheduled date of November 1 of the current season (or the next business day if November 1 falls on a weekend or U.S. bank holiday), in the exact amount of the removal fee displayed and confirmed at checkout (including any applicable Michigan sales tax). This authorization is for one (1) scheduled charge per order, not a recurring subscription. We will email you an automated reminder approximately 48 hours before the scheduled charge so you may cancel or update your card if needed. By completing checkout with this option, you expressly authorize this future charge and waive any requirement for additional pre-charge confirmation beyond the 48-hour reminder.

    Affirm + Removal Billed Before Pickup: If you pay for your order using Affirm (buy now, pay later) and select deferred removal, you will be prompted after checkout to save a separate credit or debit card on file. This card will be charged for your removal fee on November 1 under the same authorization described above. Affirm financing applies only to your display and any paid add-ons — removal is billed separately to the saved card.

    Failed Charge: If the saved card is declined, expired, or otherwise cannot be charged on November 1, we will attempt to contact you by email and/or phone within forty-eight (48) hours of the failed charge so you can provide a valid payment method. If valid payment has not been collected within seven (7) days of the original scheduled charge date, and in any event by your scheduled removal date if earlier, we may, at our discretion, decline to perform the removal service and/or pursue the outstanding balance through ordinary collection means. You agree to reimburse us for reasonable collection costs if applicable.

    Cancellation or Card Update Before Billing: You may cancel a deferred-removal authorization or update your saved card at any time before the scheduled charge by emailing hello@detroitpumpkinco.com. Once the charge has been processed, our standard Refund Policy applies.

    Customer Responsibility: If displays are removed, damaged, or disposed of by you or third parties before scheduled pickup, we are not obligated to provide refunds for removal services already paid or billed.

    Adding Removal After Original Checkout: Customers who did not select removal at their original checkout may be sent a personalized "add removal" link by our team. That link opens a short, secure checkout that pre-fills your name, email, and delivery address from your existing order and lets you pay the removal fee for that specific order. The link is single-purpose and does not grant access to any other account or order, and we may revoke or replace it at any time. Once paid, the removal is scheduled and the standard removal terms in this Section 6 apply, except that the pay-now discount described above is not offered on add-on removal purchases.

    7. Phone Orders & Verbal Authorization

    Mail/Telephone Order (MOTO) Transactions: When you place an order by phone, our team will read aloud the total dollar amount to be charged, identify the last four digits of the card to be used, and ask you to verbally confirm your agreement to be charged that amount and your acceptance of these Terms and our Refund Policy. Your verbal "yes" constitutes your authorization to charge the card and your binding agreement to these Terms.

    Recordkeeping: We retain a record of phone-order authorizations including the name of the team member who took the order, the date and time of authorization, and the last four digits of the card charged. A written confirmation of this authorization is included in your order receipt email. If anything in that disclosure is incorrect, you agree to notify us within 24 hours of receipt by replying to the receipt email.

    Order Text Messages: When you place an order and provide a mobile number, you consent to receive automated transactional text messages about that order, including an order confirmation, a link to your porch portal, and delivery and scheduling updates. These service texts are part of fulfilling your order. You can reply STOP at any time to stop them, or HELP for help. See Section 14 for full details.

    8. Business Coaching & Consultation Services

    Service Scope: Detroit Pumpkin Company offers business coaching and consultation services for individuals interested in starting or growing a seasonal pumpkin display business. These services include strategic planning, operational guidance, marketing strategies, and business development advice.

    Professional Services Disclaimer: Our coaching and consultation services are NOT a substitute for professional legal, financial, accounting, tax, medical, mental health, or therapeutic advice. We are not attorneys, CPAs, financial advisors, investment professionals, therapists, psychologists, or licensed counselors. You should consult appropriate licensed professionals before making any significant business, financial, or legal decisions.

    No Guarantees of Results: We cannot and do not guarantee any specific business results, revenue, profits, or outcomes from our coaching services. Success in any business venture depends on numerous factors including individual effort, market conditions, execution, timing, competition, capital, and circumstances beyond our control. Past results of other clients do not guarantee future results for your business.

    Client Responsibility: You acknowledge that you are solely responsible for your business decisions and actions. You assume all risks associated with implementing any strategies, advice, or recommendations provided during coaching sessions. We provide guidance and insights based on our experience, but ultimate business decisions and their consequences rest with you.

    Confidentiality: Each party agrees to keep confidential the non-public business information of the other party shared during coaching sessions, except where disclosure is required by law, court order, or where there is a reasonable belief of imminent harm. You agree not to disclose, reproduce, or share our proprietary methods, frameworks, templates, or materials with any third party without our prior written permission. Generalized insights (without identifying information) may be used by us for educational and marketing purposes.

    Session Attendance & Cancellation: Clients are responsible for attending scheduled coaching sessions on time. Cancellations or rescheduling requests must be made at least 48 hours in advance. Late cancellations or no-shows may result in forfeited session fees at our discretion.

    Intellectual Property: All coaching materials, templates, frameworks, worksheets, and proprietary methods provided are for your personal business use only. You may not reproduce, distribute, sell, or share these materials without written permission. All intellectual property rights remain with Detroit Pumpkin Company.

    Payment Terms: Coaching services are billed at the rate quoted to you at the time of booking. Payment is due prior to scheduled sessions unless other arrangements have been made in writing. Displays and extended coaching engagements may be available with separate terms. All coaching fees are non-refundable once sessions have been conducted.

    Termination: Either party may terminate the coaching relationship at any time with written notice. Detroit Pumpkin Company reserves the right to terminate services immediately if payment terms are violated, if the client engages in abusive or inappropriate behavior, or for any other reasonable cause. Prepaid fees for sessions not yet conducted may be refunded at our sole discretion.

    Technical Issues: We are not liable for technical problems including internet outages, video conferencing failures, or communication disruptions during virtual coaching sessions. Reasonable efforts will be made to reschedule sessions affected by technical issues.

    Industry-Specific Risks: The seasonal pumpkin display business involves specific risks including crop availability, weather dependence, agricultural supply chain challenges, physical labor requirements, vehicle transportation needs, and competitive market conditions. You acknowledge these inherent industry challenges and accept full responsibility for navigating them in your own business venture.

    9. Gift Options

    Detroit Pumpkin Co. offers two ways to give a porch display as a gift: Grand Gift Cards (the recipient books their own porch using a discount-locked link) and Gift a Full Display (the buyer books and pays for the recipient's entire experience).

    Grand Gift Cards

    What They Are: Grand Gift Cards are prepaid discount vouchers tied to a specific porch display. The buyer pays a display-specific amount (currently $50 for The Sprout, $75 for The Vine, $100 for The Patch, and $150 for The Grand Harvest), and Detroit Pumpkin Co. matches the buyer's contribution dollar for dollar so the recipient receives a card worth twice what the buyer paid (currently $100, $150, $200, and $300 respectively). The recipient receives a shareable link that applies the display-specific discount automatically at checkout when they book.

    Display Lock: Each gift card is tied to the specific display selected at time of purchase. The discount will only apply to that display. If the recipient wishes to book a different display, they should contact us and we will do our best to accommodate their preference.

    Purchaser Limits: There is no per-buyer limit on the number of gift cards a customer may purchase in a season. Gift cards may not be purchased and applied to the buyer's own order.

    Validity: Gift cards are valid for the current Fall season. Unredeemed cards may be refunded in full or rolled over to the following season upon request — simply contact us at hello@detroitpumpkinco.com.

    Refunds: Gift card purchases are refundable at any time prior to redemption. To request a refund, contact us at hello@detroitpumpkinco.com. Once a gift card has been redeemed and a porch order has been placed, the standard order refund policy applies to that order.

    Recipient Email: The recipient's email address entered at time of purchase is used to verify and apply the discount at checkout. If you entered an incorrect email address, contact us before the card is used and we will update it.

    Gift a Full Display

    What It Is: The buyer selects a porch display, enters the recipient's delivery address, and pays the full display price. Detroit Pumpkin Co. handles delivery, on-site setup, and the November removal at the recipient's address. The recipient receives an email with a shareable gift link and is contacted directly by our team for delivery scheduling and any preferences.

    Removal Coverage as a Gift Perk: When a display is purchased through the Gift a Full Display flow, Detroit Pumpkin Co. waives the November removal fee that would otherwise apply to that order. The buyer is not charged for removal at checkout, and the removal service is performed at no additional cost to the recipient. This perk applies only to orders flagged as gift orders at the time of purchase. Heritage displays already include removal in the base display price and are not subject to a separate removal waiver.

    Porch Points Buyer Credit: Buyers earn Porch Points credited to their account as a thank-you for purchasing a Gift a Full Display order. Point amounts vary by display tier and are subject to the Porch Points terms in Section 10 below.

    Service Area: The recipient's delivery address must fall within our published service area. If the recipient address falls outside our service area, the order will be reviewed and the buyer will be contacted before fulfillment.

    Refunds and Cancellations: Gift a Full Display orders are subject to the same refund and cancellation policy as standard porch display orders. Refer to our Refund Policy for full details. Porch Points credited to the buyer for a gift order will be reversed if the underlying order is fully refunded.

    10. Referral Program & Porch Points

    Referral Codes: Existing customers who place an order receive a personal referral code (format: first initial + last name + 2-digit year, e.g., JSMITH26). Referral codes are issued per season and remain active unless explicitly revoked.

    Recipient Discount: When a new customer applies a valid referral code at checkout, they receive a 10% discount on their display price. The discount applies to the display only and does not apply to removal, add-ons, colorway upgrades, or charitable donations made through The Big Mini Promise.

    First-Time Customers Only: Referral codes may only be applied by customers who have not previously placed an order with Detroit Pumpkin Company. We verify eligibility by email address and delivery address. Using a code fraudulently may result in the discount being reversed.

    Referrer Reward: When a referral code is successfully used and payment clears, the referrer automatically receives 50 Porch Points (1 point = $1 in value) credited to their account. Within seven (7) days of that credit, the referrer may instead choose to swap those 50 points for a $50 gift card to a local Metro Detroit steakhouse, mailed by our team. Once that 7-day window closes, the swap option expires and the points remain in the account. Detroit Pumpkin Company reserves the right to adjust, expire, or revoke Porch Points or referral rewards in the event of fraud, abuse, or program changes.

    2026 Giveaway Referral Promotion: Separately from the customer referral program above, a person who enters the 2026 Porch Giveaway may share their personal giveaway link. For each new, accepted, eligible in-area friend entry attributed to that link, the referrer may receive $25 in Porch Points toward a future porch display, up to three qualifying referrals and $75 total. A qualifying referral must be a genuine new entry; clicks, visits, partial forms, duplicate entries, self-referrals, replays, and out-of-area submissions do not qualify. Each entrant receives one giveaway entry only. Giveaway referral rewards are a separate customer promotion and do not increase, decrease, or otherwise affect anyone's odds of winning. Giveaway referral links are attribution-only: they do not provide the referred person with a discount and do not act as checkout promo codes. Porch Points are not cash and are subject to the redemption, expiration, fraud, and modification terms below.

    Promo Codes: Promotional discount codes may be issued at our discretion. Unless otherwise stated, promo codes cannot be combined with referral codes or other discounts. Codes are non-transferable and have no cash value.

    Early Bird Discount: Each season, between May 15 and June 30, an automatic Early Bird discount of ten percent (10%) is applied to the display portion of qualifying orders placed by customers who visit our Early Bird landing page before checking out. The discount applies only to the display price (it does not apply to removal, add-ons, gift cards, colorway upgrades, or charitable donations), cannot be combined with a referral code on the same order, and is not offered on gift-display orders. Detroit Pumpkin Company reserves the right to adjust the discount percentage, eligibility window, or eligibility rules for future seasons, with any changes taking effect prospectively.

    Self-Referral Prohibited: You may not apply your own referral code to your own order, directly or indirectly. Any such attempt will be reversed.

    Porch Points

    Value: One Porch Point equals one U.S. dollar in credit toward a future porch display order. Points have no cash value.

    Earning Points: Porch Points may be earned through the customer referral program (50 points per successful paid referral, as described above), the 2026 Giveaway Referral Promotion (25 points per qualifying referral, up to 75 points), by purchasing a Gift a Full Display order (as described in Section 9), and through any other program, promotion, or review reward we make available from time to time. Point amounts and earning opportunities are displayed at the time of the qualifying action.

    Redemption: Points may be redeemed toward a future porch display order by submitting a redemption request through the Porch Points hub at detroitpumpkinco.com/porch-points or by contacting us at hello@detroitpumpkinco.com. Points cannot be applied retroactively to a completed order and cannot be combined with certain promotional codes; restrictions are noted at the time of redemption. Redemptions are processed by our team and are subject to availability of the applicable season.

    Expiration & Modification: Detroit Pumpkin Company reserves the right to adjust, expire, or revoke Porch Points balances in the event of fraud, account misuse, or program changes. We may modify the Porch Points program at any time with reasonable notice.

    11. The Big Mini Promise

    What It Is: The Big Mini Promise is an optional charitable giving opportunity available at checkout. Customers may choose to donate any amount to a local Detroit charity selected by Detroit Pumpkin Company. In recognition of your donation, we double the mini pumpkins in your display, at our cost, regardless of the amount donated.

    Donation Recipient: 100% of your charitable donation goes directly to the designated local charity. Detroit Pumpkin Company does not retain any portion of donations. The featured charity may change from season to season.

    Voluntary & Optional: Participation in The Big Mini Promise is entirely optional. Choosing not to donate has no effect on your order, service level, or the quality of your porch display.

    Non-Refundable Donations: Charitable donations made through The Big Mini Promise are processed immediately and forwarded to the charitable organization. Donations cannot be refunded once processed. If you have a concern about an erroneous donation amount, contact us as soon as possible at hello@detroitpumpkinco.com and we will do our best to assist.

    Tax Deductibility: Whether your donation qualifies for a charitable deduction depends on the recipient organization's tax-exempt status and your individual tax situation. Detroit Pumpkin Company makes no representations regarding the tax deductibility of donations. Please consult a tax professional.

    12. Customer Responsibilities

    • •Provide accurate delivery address, contact information, and payment details
    • •Ensure safe, accessible delivery location with adequate parking
    • •Secure pets during delivery and removal appointments
    • •Notify us within 48 hours of delivery of any missing or damaged items
    • •Comply with local ordinances and homeowner association rules regarding decorations
    • •Maintain decorations in a safe manner that does not create hazards for others
    • •Make displays available for removal during scheduled pickup windows
    • •Keep your saved payment method valid through any scheduled future charge date

    13. Payment Terms & Refunds

    Payment at Checkout: Payment is required at time of order placement for your display and any paid add-ons selected. We accept payment via credit card or debit card processed securely through Stripe, and Affirm (buy now, pay later financing). All sales are final as outlined in our Refund Policy.

    Affirm Payments: Affirm is a third-party financing service that allows you to split your payment into installments. When paying via Affirm, your agreement is directly with Affirm and subject to their terms and conditions. Detroit Pumpkin Company receives payment in full from Affirm at the time of purchase. If you cancel or receive a refund, Affirm's policies govern how your installment plan is adjusted.

    Scheduled Future Charges: If you authorize deferred removal billing at checkout, your saved card will be charged on the scheduled date as described in Section 6 above. This is a single, non-recurring future charge in the exact amount confirmed at checkout.

    Sales Tax: Michigan sales tax is calculated on taxable goods and add-ons at the rate in effect at the time of order. Design and labor services are not taxed in Michigan; the breakdown of taxable and non-taxable amounts is shown on your receipt.

    Chargebacks: If you have a billing concern, please contact us at hello@detroitpumpkinco.com before initiating a chargeback. Filing a chargeback in bad faith — for example, after services have already been provided or where you authorized a scheduled charge — may result in collection of the disputed amount and reasonable collection costs.

    Due to the custom, seasonal, and perishable nature of our products, we cannot offer refunds for changes of mind, scheduling conflicts, or natural product variations.

    14. Consent & Permissions

    Photo & Marketing Consent: During checkout, you may choose to grant Detroit Pumpkin Company permission to photograph your final porch display and use those images for marketing purposes, including social media, website galleries, and promotional materials. If granted, this permission includes the right to crop, edit, color-correct, and use the images in perpetuity, in any medium, with no compensation owed to you. We will not include identifying address information in published images. You may update this preference at any time through your Porch Portal or by emailing hello@detroitpumpkinco.com.

    Internal Quality-Control Photos: Regardless of whether you grant marketing consent, our crew may take photos of the completed installation for internal quality-control purposes (confirming completion, documenting condition at install, and resolving any post-install issue). These internal photos are not published, shared with third parties, or used for marketing without your separate consent, and they are retained only as long as reasonably needed for operations and recordkeeping.

    Email Communication Consent: By placing an order, submitting a quote request, or signing up through our website list, you consent to receive emails from Detroit Pumpkin Company regarding your order, delivery status, seasonal availability, early access offers, and related communications. You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us at hello@detroitpumpkinco.com.

    Phone & Text Message (SMS) Communications: By providing your phone number or placing an order, you consent to receive phone calls from Detroit Pumpkin Company about your order, delivery scheduling, quotes, and support. We send text messages through the Quo (OpenPhone) business-phone system.

    Transactional (service) texts: When you place an order and provide a mobile number, you consent to receive automated text messages related to that order, such as an order confirmation, a link to your porch portal, and delivery and scheduling updates. These service texts are part of fulfilling your order.

    Promotional texts: We only send marketing or promotional text messages to buyers, such as a referral reminder or a note when booking opens for the next season, if you separately opt in by checking the promotional text box at checkout. Providing your number and opting in are not conditions of any purchase. When you submit an inquiry or interest-list form on our website and provide a mobile number, you may receive follow-up texts from our team as part of our lead-response process; a disclosure of this is shown on the form at submission.

    Rates and opting out: Standard message and data rates may apply and message frequency varies. You may reply STOP at any time to end text messages, or HELP for help, or contact us at hello@detroitpumpkinco.com.

    15. Third-Party Services

    Our Services rely on third-party providers including Stripe (payments), Affirm (financing), Resend (email delivery), Mapbox and Google (mapping and place data), Meta and AppLovin (advertising measurement and analytics), Quo / OpenPhone (business phone calls and text messaging), and other vendors. Your use of those services may be subject to their own terms and privacy policies. We are not liable for outages, delays, errors, security incidents, or other actions or omissions of any third-party service provider. Where a third party is responsible for a charge, dispute, or refund decision (for example, Affirm financing), that third party's policies control.

    16. Disclaimer of Warranties & Limitation of Liability

    Disclaimer of Warranties. Except as expressly stated in these Terms, our Services and products are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any defects will be corrected.

    Property Damage from Pumpkins & Decorations: We are not liable for property damage including but not limited to staining, discoloration, mold, weight damage, water damage, fading of painted surfaces, or any other effects from natural pumpkins, hay, corn stalks, and decorations placed on or near your property. We recommend taking precautions such as using protective barriers under pumpkins on wood, painted, or porous surfaces.

    Property Damage Caused by Our Crew or Vehicles — Notice & Claims: We exercise reasonable care while on your property. If, despite that care, our crew or delivery vehicle causes physical damage to your property (for example, lawn ruts, broken irrigation heads, scuffs to concrete or pavers, damage to porch surfaces during installation, or similar), you must notify us in writing at hello@detroitpumpkinco.com within forty-eight (48) hours of the relevant delivery or removal visit, with a clear description of the damage and photographs. Claims submitted after 48 hours will generally be denied because we cannot verify the cause. For timely, verified claims, our sole responsibility (and your sole remedy) is, at our option, to (a) arrange repair of the damaged item to substantially its pre-existing condition, or (b) reimburse the reasonable repair cost, in either case subject to the aggregate cap in this Section 16. We are not responsible for pre-existing damage, ordinary wear, cosmetic effects of seasonal weather, damage to hidden or undisclosed property (such as buried utilities or invisible-fence wires not marked at the time of service), or damage caused by you, guests, third parties, or other contractors.

    Heritage & Multi-Level Install Risk Acknowledgement: As described in Section 5, Heritage and other custom installations may involve work on porches, steps, columns, and other elevated or multi-level surfaces of your home. You acknowledge the inherent risks of installation on such surfaces and represent that you have disclosed any known structural conditions, loose railings, rotted decking, exposed wiring, or other hazards relevant to the install area. We are not liable for damage caused by undisclosed structural defects or conditions that were not reasonably visible to our crew at the time of installation.

    Personal Injury: Pumpkins and fall decorations may create trip hazards or other safety concerns. You assume all responsibility for maintaining safe conditions for visitors, guests, delivery personnel, and others who access your property. We are not liable for any injuries occurring on your property related to our products or services, except to the extent caused by our gross negligence or willful misconduct.

    Third-Party Actions: We are not responsible for theft, vandalism, or damage caused by third parties, including but not limited to neighbors, delivery services, landscapers, or trespassers.

    Force Majeure: We are not liable for delays, cancellations, or inability to perform services due to circumstances beyond our control including severe weather, natural disasters, farm crop failures, transportation disruptions, labor shortages, pandemics, governmental actions, or other unforeseeable events.

    No Indirect Damages. To the maximum extent permitted by law, in no event shall Detroit Pumpkin Company, its owners, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost data, loss of goodwill, business interruption, or emotional distress, arising out of or related to these Terms or the Services, even if advised of the possibility of such damages.

    Aggregate Cap. To the maximum extent permitted by law, Detroit Pumpkin Company's total aggregate liability to you for any and all claims arising out of or related to these Terms or the Services shall not exceed the greater of (a) the total amount you paid to Detroit Pumpkin Company in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). The existence of multiple claims will not enlarge this limit.

    Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. To the extent any such exclusion or limitation is held unenforceable in your jurisdiction, our liability is limited to the smallest extent permitted by applicable law.

    17. Indemnification

    You agree to indemnify, defend, and hold harmless Detroit Pumpkin Company, its owners, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our Services; (b) your breach of these Terms; (c) your violation of any law or the rights of any third party; (d) any content, photos, or materials you provide to us, including any third-party intellectual property claim arising from such content; (e) any injury, damage, or loss occurring on your property related to our products or services; or (f) any chargeback or payment dispute filed in bad faith. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.

    18. Binding Arbitration & Class Action Waiver

    PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS. You and Detroit Pumpkin Company agree that any dispute, claim, or controversy arising out of or relating to these Terms, our Services, or the relationship between us (a "Dispute") shall be resolved exclusively by final and binding individual arbitration, except as set forth below. This includes Disputes that arose before you accepted these Terms.

    Arbitration Procedure: The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will take place in Macomb County, Michigan, or by video/telephone where permitted by AAA rules. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. Each party will bear its own costs except as required by AAA rules; for claims under $10,000, we will reimburse your reasonable filing fees if you prevail.

    Class Action Waiver: You and Detroit Pumpkin Company agree that each may bring claims against the other only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative or class proceeding. If this class waiver is found unenforceable, then the entirety of this Section 18 shall be null and void, but the rest of these Terms shall remain in effect.

    Exceptions: Either party may (a) bring an individual action in small-claims court for any Dispute within that court's jurisdiction, or (b) seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to enforce confidentiality obligations.

    30-Day Right to Opt Out: You may opt out of this arbitration agreement by emailing hello@detroitpumpkinco.com with the subject line "Arbitration Opt-Out" within 30 days of first agreeing to these Terms. Your email must include your full name, mailing address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

    Informal Resolution First: Before initiating arbitration, you agree to first contact us at hello@detroitpumpkinco.com with a written description of the Dispute and to allow us 30 days to attempt informal resolution.

    19. Governing Law & Venue

    These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws principles. Subject to Section 18, any Dispute that may proceed in court (such as small-claims actions or requests for injunctive relief) shall be brought exclusively in the state or federal courts located in Macomb County, Michigan, and you and we consent to the personal jurisdiction of those courts.

    20. Reviews & Customer Feedback

    Public Review Page: After your installation, we may invite you to leave a review through a public review page at /leave-a-review or through a personalized review link sent to you by email or text. The personalized link is single-purpose and is used only to greet you by your first name and (where applicable) to credit any review-related reward to your account. It does not grant access to your order or account beyond that.

    Honest Reviews Only: By submitting a review you represent that the review reflects your honest opinion based on your own experience with our Services. You agree not to submit reviews that are knowingly false, defamatory, fraudulent, paid by a competitor, or that include personal information about third parties without their consent.

    Star Rating Routing: To prioritize follow-up where it is needed most, our review page routes 4 and 5 star ratings toward a public review on Google and routes 1 to 3 star ratings to a private feedback form that comes directly to our team. The decision of whether to post a review on Google is yours, and posting a Google review is governed by Google's own terms.

    Review-Related Rewards (Porch Points for Photo Reviews): As a thank-you, we may credit Porch Points to a customer's account for posting a public review that includes a photo of their porch on Google. Reward amounts are displayed on the review page at the time of posting and are governed by the Porch Points terms in Section 10. The reward is for the act of sharing a verifiable review of your own experience — it is not payment for a positive review, and we reserve the right to withhold or reverse Porch Points for reviews that appear to be fabricated, duplicated across accounts, or otherwise non-compliant with this Section 20 or with Google's review policies. You are responsible for any disclosure obligations that may apply to you under the U.S. Federal Trade Commission's endorsement guides; in general, the FTC expects reviewers who receive something of value in exchange for a review to clearly disclose that fact in the review itself.

    License to Use Reviews and Review Photos: By submitting a review or feedback to us, or by posting a public review of Detroit Pumpkin Company on a platform such as Google, you grant Detroit Pumpkin Company a non-exclusive, perpetual, worldwide, royalty-free license to display, quote, excerpt, reproduce, and adapt the text of that review and any photos you attach to it in our marketing materials, website, social media, and other promotional channels, with attribution limited to your first name and last initial (or as otherwise agreed). You retain ownership of your review and your photos. Private feedback submitted through the recovery form (1 to 3 star path) is used solely for internal service-recovery purposes and is not republished by us.

    Removal Requests: If you would like a review or review photo you submitted to us removed from our marketing materials, contact us at hello@detroitpumpkinco.com and we will take reasonable steps to do so for content we control. Reviews you have posted on third-party platforms (such as Google) are governed by those platforms' policies, and removal there is at the platform's discretion.

    21. Giveaways, Sweepstakes & Promotional Drawings

    Sponsor: All giveaways, sweepstakes, and promotional drawings offered on our website (including our 2026 Porch Giveaway) are sponsored by Detroit Pumpkin Company LLC, doing business as Detroit Pumpkin Company, of Detroit, Michigan. Detroit Pumpkin Company is the sole sponsor and decision-maker. This promotion is not sponsored, endorsed, administered by, or associated with Facebook or Instagram. It is also not sponsored, endorsed, administered by, or associated with Meta, Google, or any other platform on which it may be promoted. By entering, you release those platforms from responsibility for the promotion.

    No Purchase Necessary: No purchase is necessary to enter or win. A purchase will not improve your chances of winning. The entry form on our website is the standard method of entry; alternative entry instructions, if any, will be described on the entry page or by request to hello@detroitpumpkinco.com.

    Entry Deadline: Entries for the 2026 Porch Giveaway must be received by August 31, 2026 at 11:59 PM Detroit time. Entries submitted after that deadline are not eligible for the drawing.

    Eligibility: Unless the entry page states otherwise, entrants must be (a) at least 18 years of age, (b) legal residents of the United States, and (c) submit a valid ZIP code within our published Metro Detroit service area. The winner must have a qualifying Metro Detroit delivery address available for prize fulfillment. Employees of Detroit Pumpkin Company, our immediate family members, and our household members are not eligible to win. Void where prohibited.

    Prize: The specific prize for each giveaway is described on its entry page. For our 2026 Porch Giveaway, one (1) winner chooses one of two display options matched to the winner's submitted porch size: Sprout/Vine for a smaller porch, Vine/Patch for an average porch, or Patch/Grand Harvest for a spacious porch. The selected display includes delivery, professional setup at the winner's qualifying Metro Detroit residence, and end-of-season removal, with a maximum approximate retail value of $1,525 as shown on the entry page. The prize is non-transferable, non-exchangeable for cash, and may not be substituted, except that the sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.

    One Entry; No Odds Increase: Each eligible entrant receives exactly one entry in the drawing. Referral activity, sharing a link, following @detroitpumpkinco on Instagram, or any other social-media action does not create additional entries or improve the entrant's chances of winning. Following Instagram is optional and is not a condition of entry or winning. No purchase is necessary, and a purchase will not improve the odds of winning.

    Giveaway Referral Credit: After entering, an entrant may independently share a personal referral link. A referrer may earn $25 in Porch Points for each of the first three new, accepted, eligible in-area entries attributed to that link, for a maximum of $75. Referral credit does not affect the drawing, is not an additional entry, and is not available for clicks, visits, incomplete submissions, duplicate or replayed entries, self-referrals, or out-of-area submissions. When sharing a link, the sender should disclose that they may earn $25 in Porch Points if the recipient enters through the link.

    Selection and Notification of Winner: The winner is selected by random drawing from the pool of eligible entrants and announced on @detroitpumpkinco on Instagram on September 1, 2026. The porch-size response submitted at entry determines the pair of display options available to the winner; an eligible submitted pair will not be downgraded during fulfillment. Qualification responses may be used to verify eligibility, but do not give an entrant additional odds. The decision of the sponsor is final and binding. The winner will be notified using the contact information provided at entry and must respond and confirm eligibility within 72 hours after direct notification. If the winner cannot be contacted, is ineligible, declines the prize, or fails to respond within that 72-hour period, the sponsor may select an alternate winner or end the giveaway without a winner, in its sole discretion.

    Qualification Questions and Use of Entry Data: Some of our giveaways include qualification questions (for example, about porch size or whether you would consider booking if you do not win). Your answers are used to determine eligibility and help us understand our audience and improve our offerings; they are not used to select the winner or increase the odds of winning, as described in our Privacy Policy. By entering, you agree that your answers may be used in this way.

    Required Marketing Permissions: The 2026 Porch Giveaway uses one combined entry checkbox agreeing to receive Detroit Pumpkin Company updates and offers by email and text. This marketing consent is separate from the eligibility certification and is required to submit the entry. You may unsubscribe from email or reply STOP to text messages at any time as described in Section 14 above. Withdrawing consent does not invalidate a submitted entry, but may prevent future marketing notices.

    Taxes and Tax Reporting: The winner is responsible for any federal, state, or local taxes that may apply to the prize. If the value of the prize meets applicable U.S. tax-reporting thresholds, the winner agrees to provide a completed IRS Form W-9 (or equivalent) to the sponsor before the prize is awarded.

    Publicity Release: Except where prohibited by law, by accepting a prize the winner consents to Detroit Pumpkin Company's use of their first name and last initial, city of residence, photographs of the installed porch display, and a brief quote about their experience for marketing and publicity purposes, without further compensation.

    Cancellation and Modification: Detroit Pumpkin Company may cancel, suspend, or modify any giveaway if fraud, technical failures, or any other factor beyond its reasonable control compromises the integrity or proper administration of the giveaway, with any modifications taking effect prospectively.

    Specific Rules Control: Where a particular giveaway has its own posted official rules, those rules govern that giveaway to the extent they conflict with this Section 21. In all other respects, this Section 21 and the rest of these Terms apply.

    22. Changes to Terms

    We may update these Terms from time to time. The "Last Updated" date at the top of this page will reflect the date of the most recent change. Updated Terms take effect upon posting to our website, and your continued use of our Services after that date constitutes acceptance of the updated Terms.

    23. General Provisions

    Entire Agreement. These Terms, together with our Refund Policy and Privacy Policy, constitute the entire agreement between you and Detroit Pumpkin Company regarding your use of our Services and supersede any prior or contemporaneous agreements, communications, or representations, whether oral or written.

    Severability. If any provision of these Terms is held invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

    No Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.

    Assignment. You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice, including in connection with a merger, acquisition, reorganization, or sale of assets.

    Headings. Section headings are for convenience only and do not affect interpretation.

    Survival. Sections relating to payment, indemnification, limitation of liability, arbitration, governing law, and any other provisions that by their nature should survive termination shall survive termination of these Terms.
